Terms of Use
These terms apply to the Climbeat game for iPhone (“the app”). By downloading or playing the app you agree to them. If a child plays, a parent or guardian should read these terms and agree to them on the child's behalf.
The app is offered by its developer (“we”, “us”):
[Developer legal name], [Postal address]
1. Your licence to use the app
We give you a personal, non-exclusive, non-transferable, revocable licence to download and play the app on Apple devices that you own or control, for your own non-commercial entertainment, as allowed by the App Store's Usage Rules. These terms add to Apple's Licensed Application End User License Agreement (the standard EULA), which also applies. If the two differ, the standard EULA wins in matters between you and Apple.
The app, including its levels, artwork, characters, arrangements, sounds and code, belongs to us or our licensors. The musical compositions used in the game are in the public domain. Some arrangements are used under open licences, as listed in the game's Credits screen. Fonts are used under the SIL Open Font License.
2. In-app purchases
The app is free to play. It offers optional in-app purchases:
- Gold packs: consumable items that add gold to the game on the device you bought them on.
- No Ads: a one-time, non-consumable purchase. It removes the ads shown between levels and gives you 4 lives instead of 3 on every climb. Optional rewarded ads (for example, watching an ad to continue after losing all lives) stay available if you want them. You can restore No Ads on another device signed in to the same Apple Account through Settings → Parents → Restore purchases.
All purchases are processed by Apple and are subject to Apple's Media Services Terms and Conditions. Prices are shown in the App Store in your local currency before you confirm. We do not receive or store your payment details. Refund requests are handled by Apple at reportaproblem.apple.com. Before every purchase the app asks a question meant for grown-ups; parents can also use Apple's Screen Time and Ask to Buy features to control purchases.
3. Virtual gold
Gold is a virtual item used only inside the game, for example to unlock helmets, outfits and gloves. Gold has no cash value, cannot be exchanged for real money, goods or services, and cannot be transferred, sold or traded. You do not own gold; you have a limited licence to use it in the game. Gold is stored only on your device: if you delete the app, reset your progress or lose your device, your gold and progress are lost and we cannot restore them, because we keep no copy. Except where the law or Apple's rules require otherwise, purchases of gold are final.
4. Ads
The app shows ads from Google AdMob as described in our Privacy Policy. Ads never play during a song. We try to show only ads suitable for children, but we do not control the content of third-party ads. If you see an ad that seems unsuitable, please tell us.
5. Acceptable use
Please play fair and do not:
- copy, modify, distribute, sell or rent the app or any part of it, except as the law allows;
- reverse engineer, decompile or try to extract the source code, except where the law allows it despite this restriction;
- use cheats, bots or modified versions of the app to obtain gold or purchases you have not paid for, or interfere with the ads or the purchase system;
- use the app in any unlawful way.
6. Changes and availability
We may update the app, add or remove levels and features, or change these terms. If we change these terms in an important way, we will update this page and its effective date. We may stop offering the app at any time; if we do, the app already on your device may keep working, but we cannot promise updates or support.
7. Disclaimer
The app is provided “as is” and “as available”. To the extent the law allows, we make no warranties that it will be error-free or always available, or that your saved progress will never be lost. Take breaks and play in a safe place; rhythm games can be exciting, and you should look up from the screen now and then.
8. Limitation of liability
To the extent the law allows, we are not liable for indirect, incidental or consequential damages, or for loss of data or progress, arising from your use of the app. Our total liability to you for any claim about the app is limited to the amount you paid for in-app purchases in the 12 months before the claim. Nothing in these terms limits rights you have under consumer protection laws that cannot be waived.
9. Apple
These terms are between you and us, not Apple. Apple is not responsible for the app or its content, and has no obligation to provide maintenance or support for it. Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you.
10. Governing law
These terms are governed by the laws of [country], without regard to its conflict-of-law rules. If you are a consumer, you also keep the protection of the mandatory laws of the country where you live, and you may bring claims in your local courts.
